Introduction
These Terms of Service (the “Terms”) are an agreement between you and Loc Truong, an individual publishing as “deathemperor” (the “Publisher,” “I,” “me”). They govern your use of the Infinitus applications for macOS, desktop, Linux and iOS (the “Software”), the website at https://infinitus.run (the “Site”), and the optional sign-in and relay features (the “Services”).
By using the Software, the Site or the Services, you agree to these Terms. If you use them for an organization, you represent that you may bind it, and “you” includes that organization. If you do not agree, do not use them.
You must be at least 13 years old. If the law where you live sets a higher age for agreements like this one, you must meet it or have a parent or guardian agree on your behalf.

The Software and Its License
Infinitus is open source software published under the MIT License. Your rights to use, copy, modify and distribute the source code come from that license, which accompanies the source repository. Where these Terms and the MIT License differ as to the source code, the MIT License controls. These Terms add nothing to and take nothing from it; they govern the Site and the optional Services, which the license does not cover.
Infinitus is a fork of T3 Code, itself MIT-licensed, and includes third-party open source components under their own licenses. Those notices are available in the application and in the source repository. The names, marks and branding of other projects remain theirs.

Accounts
Infinitus works without an account. An account is needed only for the optional relay features — push notifications and device-to-environment linking. If you create one, keep your credentials secure and report suspected unauthorized access. You are responsible for activity through your account and connected devices, except where caused by a failure to use reasonable security measures on my side.
Do not share credentials in a way that compromises the Services, impersonate anyone, or create accounts by unauthorized automated means.

Your Content and Providers
Infinitus helps you send prompts, source files, images, attachments and instructions to coding-agent harnesses and providers you choose, and displays their responses, command output, file changes and diffs (“User Content”). You retain every right you have in your User Content.
You bring and configure your own harness and provider. Your User Content is processed on the machine you control and by the providers you select. It does not pass through my infrastructure. The relay, if you enable it, carries only notification metadata — thread and project titles, model name and a status headline — as described in the Privacy Policy. To the limited extent a feature you enable must transmit that metadata, you grant me a license to host and transmit it solely to provide that feature.
You represent that you have the rights needed to submit your User Content and to direct its processing by the harnesses and providers you select. Review their terms, privacy practices and data controls before using them with confidential, proprietary, regulated or personal information.

Acceptable Use
The MIT License governs what you may do with the source code and imposes no use restrictions. This section applies to the Site and the Services — the infrastructure I operate and pay for. You may not use them to:
- Violate applicable law or another person's rights;
- Distribute malware or harmful content, except in authorized security work;
- Probe, attack, disrupt or gain unauthorized access to the Services or any other system;
- Bypass rate limits, access controls or security measures;
- Place an unreasonable load on shared infrastructure, or interfere with other users;
- Facilitate fraud, harassment or deceptive conduct; or
- Misrepresent that output from a third-party agent was produced or endorsed by me.
Authorized security research should follow the Security Policy. Suspected violations may be investigated, and proportionate action taken.

Availability and Changes
Features, integrations and supported platforms may be added, changed, suspended or discontinued. Infinitus is maintained by one person in his own time: there is no uptime commitment, no support obligation and no guarantee that any feature will continue to exist. Because the Software is open source, a discontinued version remains yours to run and to fork.
Infinitus depends on software, environments, networks and coding-agent providers that you configure or that third parties operate. I control none of their availability, compatibility, pricing or behavior.

Fees
Infinitus is free. There is no subscription and nothing to buy. You remain responsible for what you pay others — your coding-agent providers, cloud infrastructure, network operators and app stores. If a paid feature is ever introduced, its price and terms will be shown before you buy anything.

Privacy
The Privacy Policy explains what information is involved and which optional features reach a server. Third-party environments, harnesses, identity providers and coding-agent providers handle information under their own terms.

Suspension and Termination
You may stop at any time: disconnect environments and devices in the app, and request account deletion as described in the Privacy Policy.
Access to the Services may be suspended or terminated where I reasonably believe you materially violated these Terms, created a security or legal risk, or used the Services in a way that could harm others or shared infrastructure. Where practicable I will give notice and a chance to cure, but may act immediately to prevent harm or comply with law. Losing access to the Services does not affect your rights under the MIT License — the Software remains yours to run.
Provisions that should by their nature survive termination — ownership, disclaimers, limitation of liability, indemnification and dispute terms — survive.

Alpha Software
Infinitus is alpha software. It may be incomplete, change without notice, contain errors or lose data. Do not rely on it as the only copy of important work, and review proposed commands and file changes before applying them. It drives coding agents that can modify and delete files on your machine — treat every automated action as something to check.

Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE, SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
Coding agents and AI systems produce incorrect, insecure, incomplete and sometimes harmful output. You are responsible for reviewing output, commands and patches before relying on or executing them. Nothing here warrants that the Software or third-party output will be uninterrupted, secure, accurate, error-free or fit for your purpose.
Some jurisdictions do not allow certain exclusions, so parts of this may not apply to you.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SOFTWARE, SITE, SERVICES OR THESE TERMS.
To the maximum extent permitted by law, total liability for all claims arising from or relating to the Software, Site, Services or these Terms will not exceed one hundred United States dollars ($100). Infinitus is provided free of charge; this limit reflects that. It applies regardless of legal theory and even if a remedy fails of its essential purpose, and does not limit liability that cannot lawfully be limited.

Indemnification
To the extent permitted by law, you will defend and indemnify the Publisher from third-party claims, damages, losses and reasonable legal fees arising from your User Content, your use of the Site or Services in violation of these Terms or law, or your infringement of another person's rights. You will be notified promptly of any covered claim and I will cooperate reasonably in its defense. Do not settle a claim in a way that admits fault by me or imposes obligations on me without my written consent.

Copyright Complaints
If you believe material on a part of the Site or Services that I operate infringes your copyright, send notice to deathemperor@gmail.com identifying the copyrighted work, the allegedly infringing material and its location, your contact information, a statement of good-faith belief, a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and your signature.
Content held only in a user's own environment or by a provider they selected is outside my control. Direct requests about that material to whoever hosts it.

Third-Party Services
Infinitus connects to and displays content from third-party coding agents, model providers, identity providers, repositories, app stores and infrastructure. Your use of those is governed by their terms. They are neither endorsed nor controlled by me, and I am not responsible for their content, security, availability, output or data practices.
Third-party and open source software included with Infinitus is governed by its own license notices, which control over these Terms for that software.

Feedback
If you send ideas, suggestions or other feedback about Infinitus, you grant me a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or compensation. This does not transfer ownership of your User Content. Code contributions are governed by the repository's license and contribution guidelines, not by this section.

Governing Law and Disputes
These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles. Nothing here deprives you of the protection of mandatory consumer-protection laws of the country where you live.
Talk first. Before starting any proceeding, please email deathemperor@gmail.com describing the dispute and what you want. Most problems with a free, open source tool can be settled in an email thread, and both of us should try in good faith for at least 30 days. If that fails, disputes will be resolved in the competent courts of Ho Chi Minh City, Vietnam, or in the courts of your own country of residence where the law gives you that right.
There is no arbitration requirement and no class-action waiver in these Terms. You keep whatever procedural rights your local law gives you.

Miscellaneous
These Terms, with the documents they reference, are the entire agreement between us about the Site and Services. If a provision is unenforceable, it will be narrowed to the minimum extent necessary or severed, and the rest continues in effect. Failure to enforce a provision is not a waiver of it.
You may not assign these Terms without my written consent. I may assign them in connection with a transfer of the project. Neither of us is liable for delays caused by events beyond reasonable control. Headings are for convenience, and “including” means “including without limitation.”

Changes to These Terms
These Terms may be updated from time to time. Updates are posted at this URL with the dates above revised. Where a change materially affects your rights, additional notice will be given where practicable or where the law requires. Changes apply from their effective date, and continued use after that date means you accept them.
